SACRAMENTO – The wife and adult children of a man who died of an infection allege the infection was caused by the use of a medical device.

Carol Bopp, Heather Bopp and Jason Bopp filed a complaint on June 1 in the U.S. District Court for the Eastern District of California against Livanova Deutschland GMBH and Sorin Group USA Inc. alleging negligence, strict products liability and other counts.

According to the complaint, the plaintiffs allege that on Sept. 29, 2015, plaintiffs' decedent Donald Bopp underwent open heart surgery at Kaiser Foundation Hospital in Los Angeles. The suit states that as a result of using defendants' Sorin HCD during the surgery, he contracted a mycobacterium infection. He died on Aug. 28, 2017, following a surgery to address the infection.

The plaintiffs hold Livanova Deutschland GMBH and Sorin Group USA Inc. responsible because the Sorin HCD was defective at the time it was designed and manufactured and that the design prevented it from being reliably and consistently cleaned.

The plaintiffs request a trial by jury and seek all damages suffered and legal fees, plus interest, costs and such other just and proper relief. They are represented by Andrew C. Bryman of Law Office of Bryman & Apelian in Calabasas.
